Terms of Service

1. Acceptance of Terms

By using or playing Chessingo ("the Game"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not access or use the Game. These Terms constitute a legally binding agreement between you and Tyga.Cloud Ltd ("Company", "we", "us"), a company registered in England and Wales (Company No. 14643275).

2. Eligibility

You must be at least 18 years of age to play the Game. The Game includes chat and other interaction with other players, so it is not available to anyone under 18, with or without the consent of a parent or guardian. In-app purchases must be made by the account holder or with the permission of the person responsible for the payment method.

3. The Service

Chessingo is an online chess game played in your web browser. You play other players and members of the Chessingo network. When a network member is not playing live, their moves are played by our chess engine at their rating, and their chat replies are generated by artificial intelligence; that chat is fictional and intended as entertainment. Practice opponents and the training tutor are computer programs. We reserve the right to modify, update, add or remove levels and features, suspend, or discontinue any aspect of the Game at any time, with or without notice. We do not guarantee uninterrupted access to the Game.

4. Accounts & Progress

You may play as a guest or create an account to save your progress across devices. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must not share, sell, trade, or transfer your account. You must notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms without notice or refund.

5. Virtual Currency & Purchases

The Game features a virtual currency, "Coins", and cosmetic items such as boards and piece sets. Coins are earned through play and may also be purchased, and memberships may be purchased as a subscription, through our online shop and payment provider.

No real-world value: Virtual currencies and virtual items have no monetary value outside the Game. They cannot be exchanged for real currency, transferred between accounts, or redeemed for cash.

Not gambling: Coin stakes on games use virtual Coins only. No real money is wagered, won, or paid out, and Coins cannot be cashed out.

Refund policy: Purchases are generally final. A refund may be granted at our sole discretion within 14 days if the purchased items have not been consumed. This does not affect your statutory consumer rights under UK or EU law.

Balance adjustments: We reserve the right to adjust virtual item balances, pricing, earn rates, and availability at any time to maintain game balance.

6. Fair Play

You agree not to: use cheats, bots, automation tools, memory editors, or exploits; reverse-engineer, decompile, or modify the Game; tamper with scores or leaderboards; attempt to obtain virtual items without paying where payment is required; or use the Game for any illegal purpose. You must report bugs and exploits rather than abuse them. Violations may result in loss of progress, removal from leaderboards, temporary suspension, or permanent ban, at our sole discretion.

7. Leaderboards & Events

The Game may include leaderboards, tournaments, and limited-time events. We may reset, adjust, or remove leaderboard entries and event rewards where we detect cheating or technical error. Event rules and reward availability may change at any time.

8. Intellectual Property

All Game content, including but not limited to code, artwork, music, sound effects, board and level designs, characters, character designs and names, logos, user interface elements and written text, is the exclusive property of Tyga.Cloud Ltd or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to play the Game for personal, non-commercial use. You may not copy, distribute, modify, create derivative works from, publicly display, or commercially exploit any Game content without our prior written consent.

Copyright. Chessingo is an original literary and artistic work. Copyright in it arose automatically on creation under the Berne Convention for the Protection of Literary and Artistic Works, administered by the World Intellectual Property Organization (WIPO), which protects it in every one of the Convention's contracting parties without registration or any other formality. Its software is further protected as a literary work under the WIPO Copyright Treaty and the WTO TRIPS Agreement. All rights are reserved by Tyga.Cloud Ltd.

Trade marks. CHESSINGO™ and the CHESSINGO logo are trade marks of Tyga.Cloud Ltd, used in connection with online and downloadable computer game software. They are asserted as unregistered trade marks and are marked ™. Nothing here claims registration.

Prohibited uses. Without our prior written consent you may not decompile, disassemble or reverse engineer the Game, scrape or extract its content or data, or use any part of the Game, including its text, art, characters or game records, to train or develop machine learning or generative systems.

9. Third-Party Services

The Game relies on third-party services including our online shop and payment provider, email delivery, real-time messaging, artificial intelligence chat generation, gameplay analytics, and cloud hosting providers. We are not liable for failures, outages, or issues caused by third-party services. Those services are subject to their own terms and privacy policies.

10. Limitation of Liability

The Game is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, our total aggregate liability to you for any claims arising from your use of the Game shall not exceed the greater of: (a) the total amount you have paid us in the 12 months preceding the claim; or (b) GBP 100.

We shall not be liable for: loss of virtual items, currency, or game progress; interruptions to service; or any indirect, incidental, consequential, or punitive damages.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

11. Termination

You may stop playing and delete your account at any time by contacting us. We may terminate or suspend your account at any time for violation of these Terms or for any reason at our discretion. Upon termination, your licence to use the Game ends immediately and virtual currency and items are forfeited. Data will be retained for 30 days to allow account recovery, after which it will be permanently deleted (except where retention is required by law).

12. Dispute Resolution

Before initiating any formal proceedings, you agree to contact us at legal@tyga.cloud and allow 30 days for informal resolution.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer in the EU, you retain the right to bring proceedings in your country of residence.

13. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via in-game notification or an update notice. Continued use of the Game after changes constitutes acceptance of the updated Terms. If you disagree with changes, you must stop using the Game.
